EMPLOYMENT AGREEMENT (WITH CONTRIBUTION BENEFIT )
中央研究院 所(處)(以下簡稱甲方)為應(yīng)業(yè)務(wù)需要,聘(雇)用 先生(女士)(以下簡稱乙方)為約聘(雇)人員,雙方訂立契約條款如左:

4. B’S OBLIGATIONS AND TERMINATION
乙方受聘(雇)后須確保甲方公務(wù)機密,有保密期限者從其規(guī)定,無保密期限者自離職日起三年為限(解聘(雇)者亦同)。乙方不得有不法行為或違背約定義務(wù),如有違背者,除涉及民、刑事責(zé)任,由甲方依法追究外,并得隨時解聘(雇)。
4.1 B SHALL HANDLE IN A CONFIDENTIAL MANNER ALL MATTERS RELATING TO A’S BUSINESS. THIS CONFIDENTIALITY OBLIGATION SHALL REMAIN EFFECTIVE DURING THE PERIOD SPECIFIED IN THE REGULATIONS OR WORKING RULES CONCERNED. IN CASE THAT NO TIME PERIOD IS SPECIFIED, IT REMAINS EFFECTIVE FOR SUCCESSIVE THREE (3) YEARS’ TERMS AFTER B’S TERMINATION OF THIS EMPLOYMENT.
IN THE EVENT THAT B VIOLATES ANY LAW OR REGULATION, OR BREACHES THIS AGREEMENT OR WORKING RULES CONCERNED, A MAY IN ITS DISCRETION REPRIMAND B OR TERMINATE THIS AGREEMENT. A ALSO RESERVES THE RIGHT TO INSTITUTE SUIT AGAINST B FOR CIVIL COMPENSATION OR TO IMPOSE CRIMINAL LIABILITY.
在聘(雇)用期間,乙方愿接受與甲方約定之工作上的指派調(diào)遣,并遵守此工作上之相關(guān)規(guī)定。若乙方違背上述相關(guān)規(guī)定確屬情節(jié)重大,甲方得隨時終止契約;甲、乙雙方如因特別事故須提前終止契約時,應(yīng)于一個月前提出預(yù)告,經(jīng)甲、乙雙方協(xié)議后乙方始得離職。乙方離職時,應(yīng)先依照規(guī)定辦妥離職手續(xù)。如有損害公物,或侵權(quán)情事(或違反甲方智能財產(chǎn)權(quán)規(guī)定),應(yīng)負(fù)責(zé)賠償。

根據(jù)中華人民共和國民法典和民法典的相關(guān)規(guī)定,甲方、乙方和擔(dān)保方經(jīng)過協(xié)商,就乙方向甲方貸款事宜達(dá)成如下合同條款。
第一條借款金額Article1AmountofLoan
詳見本合同第十四條第一款。
第二條借款用途Article2PurposeofLoan
詳見本合同第十四條第二款。
第三條借款利率Article3InterestofLoan
一、借款利率詳見本合同第十四條第三款。
二、本合同履行期間,遇中國人*銀行貸款利率調(diào)整,借款利率按有關(guān)規(guī)定調(diào)整與執(zhí)行,乙方將在營業(yè)場所對貸款利率調(diào)整情況進(jìn)行公告,不再另行書面通知甲方。
第四條借款期限及還款總期數(shù)
一、借款期限詳見本合同第十四條第四款。
二、實際借款發(fā)放日與本合同約定的日期不一致時,以實際借款發(fā)放日為準(zhǔn)計算借款期限。
三、甲、乙雙方約定甲方按期還款,確定還款總期數(shù),詳見本合同第十四條第四款。
第五條借款發(fā)放Article5ReleaseofFundsundertheLoan
一、乙方發(fā)放借款的前提是甲方提供了符合乙方要求的證明材料,履行了乙方要求的申請借款和擔(dān)保手續(xù),簽署了申請借款所需法律文件并經(jīng)乙方審查同意。
二、甲方授權(quán)乙方在審查同意后,將借款直接劃入甲方指定并經(jīng)乙方認(rèn)可的賬戶(賬戶名稱、賬號詳見第十四條第五款),即為乙方依約履行了向甲方提供借款的義務(wù)。
三、本合同項下的借款發(fā)放后,甲方就所購商品或服務(wù)發(fā)生的任何糾紛,均與乙方無關(guān),本合同應(yīng)正常履行。
第六條借款償還Article6RepaymentoftheLoan
一、甲方應(yīng)根據(jù)乙方相關(guān)貸款辦法規(guī)定,在下述四種還款方式中選擇一種方式歸還借款本息,甲方選擇的還款方式詳見本合同第十四條第六款:
二、甲方應(yīng)當(dāng)于乙方規(guī)定的每期還款日(詳見第十四條第六款)前,將當(dāng)期應(yīng)償還的借款本息及逾期的罰息、復(fù)利等足額存入在乙方開立的還款賬戶(賬戶名稱及賬號見第十四條第六款),并不可撤銷地授權(quán)乙方于當(dāng)期還款日直接從該賬戶劃收應(yīng)收款項。

incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesordisasters,partyawillberesponsibletorepairandpaytherelevantexpenses.3.甲方應(yīng)確保出租的房屋享有出租的權(quán)利,反之如乙方權(quán)益因此遭受損害,甲方應(yīng)負(fù)賠償責(zé)任。

partybwillpaytherental,thedepositandotherexpensesontime.2.乙方經(jīng)甲方同意,可在房屋內(nèi)添置設(shè)備。租賃期滿后,乙方將添置的設(shè)備搬走,并保證不影響房屋的完好及正常使用。
partybmaydecoratethepremisesandaddnewfacilitieswithpartya\’sapproval.whenthiscontractexpi res,partybmaytakeawaytheaddedfacilitieswhichareremovablewithoutchangingthegoodconditionsofthepremisesfornormaluse.3.未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租,并愛護(hù)使用該房屋如因乙方過失或過錯致使房屋及設(shè)施受損,乙方應(yīng)承擔(dān)賠償責(zé)任。
